Frankly, I think it's just because the song isn't that catchy. While I'm not a fan of "Born This Way" either, I too prefer it over "Judas".
Gaga just isn't doing it for me with these singles. I feel like she's trying to steer away from the more simple pop tune, yet I find most of the themes in the previous era to be more interesting.

I'm a bit surprised about Judas' underperformance so far, but if I had to guess why, it's probably because it's not instantly catchy and the production might turn people off.

I always had a theory that the hottest star in music at the moment could release anything, including junk and it would go to #1. 'Judas' proved me wrong. Yes I think the controversial nature of the song is what is keeping it down The "Madonna"-song she released before this was much better I think BTW just killed all her buzz. There was this crazy anticipation for new material from her, but the first single left many people underwhelmed and wasn't as successful as expected, so I guess her buzz just died down...

I don't think it's as easy as saying it's the nature of "Judas" that's keeping it from exploding (we've seen controversial matters- especially religious ones- not really hinder a track's success- see "Like a Prayer"). It may be part of it, but perhaps not the only reason (aside from subjective views of its quality).
Steph G's album still should see pretty impressive debut numbers, I'd think.

I think the problems is GaGa knows she has established herself already. She probably feels now she's entitled to make the music that she likes - as evidenced in the contents of her song - and took a gamble to see if her fans will still buy her music. She's pretty confident about her fanbase. I applaud her for that. While BTW is trash to me, and Judas was not catchy the first instance I heard it, it's actually very catchy. I do believe that the content of the song is what's throwing people off. Even I feel kind of indifferent when hearing a song that mentions Judas

She's simply trying to push the envelope too hard and it's finally backfiring. How many different ways can you try to be different and shocking? She'll eventually fade out like George Michael & Cyndi Lauper did after their first few albums.

^Well, Mimi Daily (which is "in" with Mimi's label) did have contests of some sort, but it usually does that for any single release. :) I don't think an unofficial website doing a download contest did anything for that song, or any of her other songs, even if it is "in" with her label.

major problem with Lady Gaga is her statements were usually bolder than the end products
BTW is supposedly bout being indifferent is equally right but what's with the video's self-indulgence & overproduction...i think "Firework"'s is better and relatable plus the whole "Express Urself" thingy
"Judas" irked with it's ridicolous sentiment but the song is very catchy...but again overhyped
cant wait to see the video though

I'm not even concerned about the performance of 'Judas'. It's Top 20 on CHR/Pop and has been in the Top 20 on iTunes ever since it's release, which is more than ABOVE AVERAGE for a song that's been out only three or four weeks. Even if it's sales are declining a little, they'll likely go up after Oprah (if she performs it there) and the music video release later this week. They've got lots of promotion planned for it, so I doubt her label is going to abandon it. for a considered "flop" single, Judas is very lucky to crack the top 10

Critics have noticed similarities with "Bad Romance" in the composition of "Judas". Jonathan Van Meter from Vogue gave the song a positive review, saying the song sounds like "it was written for the Ronettes, but set to a sledgehammering dance beat and is about falling in love with a backstabbing man of the biblical variety."[4] MTV's James Dinh noted that the song was very similar to "Bad Romance".[22] Popjustice also compared it to "Bad Romance" naming it "a highly evolved, Titanium-plated 'Bad Romance' from the year 2511 travelling half a millennium back in time to save music from a tidal wave of 'in the club'-obsessed pop drivel, and that's 'Judas'. We love this song so much. It's pop in all the right ways, it's noisy in all the right ways, it's brash and bombastic and funny and audacious and stupid in all the right ways, and it's smart in all the right ways, too.[9] Kevin O'Donnel from Spin felt that "[t]rue to form, Gaga delivers a rowdy, industrial-disco banger, and her performance is insanely over the top: She alternates between rapping, a robotic monotone, and a crow-like squawk — before gliding into a more conventional chorus that hews closer to 'Bad Romance'."[23] He added, "there's no denying the primal energy of "Judas," and the awesomely dark, bass-heavy breakdown (where Gaga shrieks like some sort horny futuristic droid) is one of the weirdest moments to hit the pop landscape this year."[23] Eric Henderson from Slant Magazine noted that the "connection and deviation from her previous single ['Born This Way'] couldn't be more pronounced. Amos Barshad from New York declared that " If we were zooted out of our minds at five in the morning on a dance floor in the sketchy part of Berlin right now, this would almost definitely be the greatest song we'd ever heard."[25] Dan Martin from NME was of the opinion that "'Judas' is the song that Lady Gaga should have come back with. You can see why she didn't, since it is employs so many of the hallmarks that make a Gaga song a Gaga song. It's typically Gaga, unmistakably in the same lineage as 'Bad Romance' and 'Poker Face'."[13] Matthew Perpetua from Rolling Stone wrote that "'Judas' is a straight-ahead dance pop number that plays to the singer's established strengths. Though 'Judas' certainly has its own charms and at least three insanely catchy hooks it leans hard on Gaga's signature moves."[26] Maura Johnston of The Village Voice describes the single as "nastier and darker, but ‘Judas’ definitely mines the same territory as ‘Bad Romance’ – lots of instantly memorable wordless vocalizing, a pummeling beat, lyrics about a romance that is, well, bad."[27] Robert Copsey from Digital Spy gave the song five out of five stars and added that "[the] chorus [is] so blasphemously camp that it's worthy of Eurovision – a Scooch-meets-Lordi affair that, unsurprisingly, takes a few listens to get your head around. Thankfully, we can confirm that it's worth the effort."[28] Mark Lepage from The Gazette praised the song saying that "Yes, she’s got a conflicted relationship with him. Judas, I mean. As some of us have with her. Because now that Lady Gaga has undeniably vaulted from the ranks of zany disco queenette to full-fledged pop chart subversive, your Bad Romance with her has become serious."[29]

The over 40 discussion is an interesting one. Mariah is perfectly placed to be the next real test subject to give us a more definitive answer since she still so very high profile and has seen some chart success in recent years.
I would have mentioned JLO would be but it is difficult to ascertain how successful her return would have been without the AI platform or a hot featured artist.
Personally, I think Mariah's next single will generate significant initial interest but its longevity will be determined by the strenght of the material as it relates to the music landscape. She no longer has her name to float on.
