Kim Porter Planned 'Dramatic' Split from Diddy THURSDAY SEPTEMBER 06, 2007 01:00 PM EDT

For the first time since Kim Porter and Sean "Diddy" Combs broke up in July, she is speaking - and quite openly - about the split.
Confirming to Essence.com that, despite their number of years together, she waited until Combs was out of town before packing up the house and taking everything - including the cars, the kitchen table and the nursery furniture for their youngsters - "because there was no other way. You think he would have let me walk out the door? He wouldn't have wanted me to go," she says.
"I wanted to be dramatic. I wanted him to know I wasn't breaking up with him for two weeks - or maybe leaving for two days. If I pack up everything - twins and all - it means I'm out! Puffy's an action person, not a talk person. So I had to have an action. Telling him, 'Babe, I'm leaving ?' was not gonna do it."
As for why she ended the relationship, she says, after being asked about rumors that Combs fathered a child with another woman, "Hmmm ... Well, that definitely was part of it."
But, she also says, "I left because at this point in my life I want something different for myself. I invested 10 years, I have children, and I've always stood by him. But now it's time for me and what I want to do for Kim."
When contacted by PEOPLE, a rep for Diddy said: "We're not commenting."
Porter, 36, and Combs, 37, are parents to son Christian, 9, and twin daughters D'Lila Star and Jessie James, born Dec. 21. (Combs also has another son, Justin, 13, with stylist Misa Hylton-Brim; Porter has a teenage son, Quincy, with singer Al B. Sure.)
Asked if she'd marry Combs if he asked her, Porter replies, "I would say 'No.' And not because I don't want to get married, but because he's not ready to get married. When I get married, I want to stay married. I want both parties to be on the same page at the same time, and to leave a certain type of behavior behind. That's a commitment I don't think he's ready for."
Which is not to say the two are feuding. Over the Labor Day weekend, the former couple and their twins were playing together at his annual White Party in New York's East Hampton.
And, as Porter tells Essence.com: "You know how when two people go their separate ways, most of the time there's animosity? It's not like that with us. Sean and I have this bond, this friendship. It's not about 'if you're faithful to me, if I'm being faithful to you.' We're friends. I'm the person he can tell his inner most thoughts to, and he's that person for me. He still calls me everyday and we talk."
She adds, "There's no ill feeling or 'I can't stand you, I hate you, don't call.' There's none of that. We have three children together so that's just not an option. We're committed to our children even if we couldn't commit to each other."

Diddy gives photographers a whiff of his new fragrance, Unforgivable Woman, at a launch party Wednesday in New York. "It follows in the footsteps of Unforgivable Man," he told PEOPLE. "It was understated, but yet it had a seductive scent to it."

MIAMI (AP) -- A former associate of Sean "Diddy" Combs has filed a lawsuit from prison against the hip-hop mogul, claiming Combs owes him more than $19 million for music by the late rapper Notorious B.I.G.
James Sabatino, a former consultant for Combs' Bad Boy Entertainment Inc., said he flew B.I.G. to Miami in 1994 to perform a show and record some music. The rapper, whose real name was Christopher Wallace, recorded about 17 minutes of vocals, and the session was also captured on about 90 minutes of video footage.
It was understood that both belonged to Sabatino because he paid for the rapper's travel expenses and studio time, although a contract was never signed, according to the lawsuit.
Combs' attorney did not immediately comment Saturday night. Sabatino is still in prison, and a listing for his attorney could not be found.
B.I.G. was killed in 1997 in what a still-unsolved homicide. Later that year, Combs agreed to buy the music and video footage from Sabatino for $200,000. Combs gave Sabatino a check for $25,000 and promised the rest of the money in 60 days, according to the lawsuit.
Combs said the reason for the delay was that Los Angeles police had named Sabatino a person of interest in the rapper's death. Sabatino and Notorious B.I.G. were scheduled to meet the night of the killing, but Sabatino never showed up.
Combs worried it could be misconstrued if the public found out his company had paid a person of interest in the killing, the lawsuit said.
Sabatino was later incarcerated on unrelated charges but still tried to get the money from Combs. He was repeatedly told it was coming soon, according to the lawsuit.
The $19 million is being sought for both actual and punitive damages, the lawsuit said.
Sabatino says in the lawsuit that he felt pressured not to talk about the dispute because Combs had been questioned by police about the rapper's death. Combs apparently told police he did not feel Sabatino was involved in the slaying, but Sabatino says he feared Combs would change his story and implicate him even if it was not true.

LOS ANGELES (AP) -- Sean "Diddy" Combs does not have to provide photos of his rings to a man who claims the rapper struck him outside a Hollywood club, a judge ruled Wednesday.
A Superior Court judge denied requests by Gerald Rechnitzer to see photos of the rings Combs wore that night.
The rings were "critical to the biomechanics of this case," Rechnitzer's lawyer, Michael M. Marzban, argued in his motion.
However, Judge Robert L. Hess ruled that the photographs weren't essential.
Rechnitzer's suit contends that Combs battered him without provocation and caused him to "fly backward several feet" in the parking lot outside a Hollywood Roosevelt hotel nightclub early on Feb. 25.
The suit claims Combs was upset that Rechnitzer's girlfriend had declined to leave the club with him.
Combs' lawyer, Benjamin Brafman, has called the allegation a "flat-out lie" and denied Combs hit anyone.

A lawyer for Sean "Diddy" Combs says the club fight involving the hip-hop mogul in the early hours of Saturday morning has been blown out of proportion, and that it was not a criminal act.
"We are hopeful that this matter will be resolved without the filing of any criminal charges, as this was a disagreement among acquaintances, not a criminal assault," the attorney, Benjamin Brafman, said in a statement.
Combs, 37, got into a shouting match with clubgoer Steven Acevedo, 31, at the New York City night spot Kiosk early Saturday, then punched him twice and knocked him to the ground, according to the New York Daily News.
The News and other media outlets reported that Combs was expected to surrender to police on Tuesday to face assault charges, but Brafman denied that.
"What is being reported in the media is inaccurate," Brafman said. "Mr. Combs is not going to be arrested today."
Another source agreed: "Sean isn't being arrested, and he's not going into the NYPD precinct today."
Acevedo and his lawyer both declined to comment to the News on Monday.
The source told PEOPLE that Combs and Acevedo, who works in the clothing business in Manhattan, have known each other for more than 10 years: "They travel in the same circles, go to the same clubs, et cetera. They're not really friends, but they're acquaintances."
The reported dispute was allegedly over a woman, but the source claimed that was not true. "This wasn't over a girl. I'm not sure what the disagreement was over, but I'm told it definitely wasn't over a girl."
Combs was spotted out on the town again on Monday night, at Butter, where he partied with Jay-Z and John Mayer. Acevedo, according to TMZ.com, was spotted leaving the club within ten minutes of Combs.

NEW YORK (AP) -- Just five years ago, Sean "Diddy" Combs asked Busta Rhymes to "pass the Courvoisier." These days, it's all about the vodka.
The 37-year-old hip-hop mogul has inked a multiyear deal to develop the Ciroc vodka brand - one of Diageo PLC's superpremium lines - for a 50-50 share in the profits.
It's the latest agreement in which a celebrity is going beyond the typical endorser role to share in a brand's rise and fall, such as Jay-Z with Budweiser and 50 Cent with Vitamin Water.
Diageo said the agreement could be worth more than $100 million for Combs over the course of the deal, depending on how well the brand performs.
"It is not an endorsement deal," Combs told The Associated Press on Tuesday night. "This is something that will have my daily attention."
Combs said he wanted to work with Diageo because the company understood that "I'm not just a celebrity endorser, I'm a brand builder. I'm a luxury brand builder."
Combs said he will be responsible for everything from marketing the brand to deciding where to sell it, and will focus on attracting "movers and shakers" to the line.
"They're looking for something that tastes like their lifestyle," he said. "It's that trendsetter, that hipster, someone who's looking for luxury and looking for something better."
Combs already has his own perfume and clothing line, and serves as chief executive of record company Bad Boy Worldwide Entertainment.
"I can't overhype someone into loving vodka," he said. But once consumers actually taste Ciroc, "I think we can convert a lot of people."

NEW YORK (AP) -- Sean "Diddy" Combs won't face criminal charges for reportedly punching a man after a dispute at a trendy SoHo nightspot last month, prosecutors said Tuesday.
The accuser stopped cooperating with law enforcement and also gave different versions of the incident, the Manhattan district attorney's office said, and prosecutors weren't able to prove criminal charges beyond a reasonable doubt.
The 31-year-old accuser told police he and Combs had been arguing over a woman early in the morning of Oct. 13 before the rap mogul punched him in the face.
Combs' attorney, Benjamin Brafman, called the incident a disagreement between acquaintances who have known each other for 12 years.
Brafman said he was pleased that no charges would be filed against the 38-year-old Combs.
"Both Mr. Combs and I are pleased that the DA's office and the police department conducted a very thorough investigation and came to this conclusion," Brafman said.

LOS ANGELES (AP) -- Four eyewitnesses support a man's assertion that Sean "Diddy" Combs assaulted him and his girlfriend at a post-Oscar party at a Hollywood nightclub last year, according to court papers filed by the plaintiff's attorney.
Marianna Ruiz, one of the witnesses deposed by an attorney for Gerard Rechnitzer, said in papers filed Wednesday that the rap and fashion mogul struck Rechnitzer unprovoked.
"I just kind of remember seeing him go flying, not flying as in like feet off the ground, but he went back significantly," said Ruiz, who was part of a group at the club with the Rechnitzer. "I was just in shock that somebody would ... just kind of strike somebody out of nowhere."
Another witness, Michael Sherman, said "all of a sudden, he hit him. And there was a taxi behind Gerard. Gerard got knocked into the taxi."
Sherman said Combs then tried to spit on Ruiz, who was standing nearby.
Rechnitzer seeks unspecified damages in the suit filed in Los Angeles Superior Court last year. He claims the assault occurred in the early hours of Feb. 25 outside Teddy's at the Roosevelt Hotel.
Attorneys for Combs have called the suit "completely baseless" and in court papers filed Wednesday said he is "in no way legally responsible for what happened to Rechnitzer."
A message left for Combs attorney Hillary A. Jones after business hours Friday was not immediately returned.

Sean "Diddy" Combs partied the night away on Oscar Sunday – but he still had some time to think about baby gifts for former girlfriend Jennifer Lopez.
On the red carpet at the Academy Award ceremony at the Kodak Theater, the mogul, 38, told PEOPLE that Lopez (now the proud mother of twins) "is going to make a great mother.
"I'm going to send her some Sean John baby clothes," added the dapper Diddy, wearing a tux by Dolce and Gabbana. "I'm so happy for her. It's such a blessing."
Asked if he had any advice for Lopez, 38, Diddy, who is also the father of twins, replied, "It's double the love, and it's also double the crying and the screaming, so it's a unique blessed situation. It's a rarity to have twins. She'll be all right."
