Adam Lambert Facing Copyright Infringement Lawsuit

Adam Lambert is sued by Colwel Platinum Entertainment Inc. for "a 504 Copyright infringement case." The lawsuit is tied to a song called "Beg for Mercy" which he reportedly worked together with his guitarist Monte Pittman before he took part in "American Idol" two years ago.

The lawsuit seems to be in retaliation for the takedown notices Adam’s reps sent to Amazon.com, which had the album up for sale. It is probably what RCA expected and my guess is RCA will drag this case out preventing him from releasing anything while the case is pending. Idol doesn't have anything to do with this old recording. But it sure makes a more sensationalized headline than 'copyright infringement.' I will also bet Idol's lawyers thoroughly checks all the contestants background with a fine tooth. It's not likely Idol will waste their time going after one of their successful Idols. more likely they would welcome the free idol press this will generate. There's nothing like a good controversy that will go nowhere.

Also some info from a lawyer that deals with cases like this.

First, the statute of limitations for breach of contract is 4 years if it is a written contract, 2 years if its an oral contract. It looks like this was filed within the statutory period and the complaint might be triggered by the approach of the expiration of hte period.

Second, this was filed in federal court, which means that the attorney representing Colwel is required to have facts to support the claim. Allegations on "information and belief" suggest that they don't have those facts (such as what was told Amazon).

Third, the allegation regarding the disqualification is a complete throwaway claim designed to embarass and get publicity. I cannot imagine an relevance to a claim if Adam lied to Idol. That's between he and Idol.

Last, the judge in this case, Percy Anderson, is a major hardass judge who does not tolerate b.s. He is particularly hard on plaintiffs and criminal defendants (and thieir counsel). Adam Lambert Lends Voice to Queen for MTV Europe Music Awards Performance

Singer Adam Lambert lent his vocals to the rock group Queen Sunday night at the MTV Europe Music Awards in Belfast, Ireland. Queen was honored with the Global Icon Award for it's legendary musical contributions, and in the absence of their late/great front-man Freddie Mercury, The Band asked Lambert to perform a medley of hits starting with "The Show Must Go On," followed by "We Will Rock You" and "We Are The Champions." Such a task would No Doubt be daunting for many a singer, but not for Lambert.

At the end of the day, he delivered.

The most notable thing about his performance was that Lambert did not make the slightest attempt to diminish Mercury's genius by trying to duplicate him. Instead, he infused his own brand of genius into the arrangement. It was an homage to one of Lambert's admitted heroes and a golden moment for he and his fans - perhaps for some Queen fans as well.

But not all of them.

Just moments after the performance, some of Queen's most faithful fans began buzzing about Lambert's audacious belief that he could replace Freddie Mercury and that under no circumstances should anyone attempt to front the group except it's original singer. They are also not prepared to accept the argument that Lambert was not trying to fill Mercury's shoes, but instead was merely helping The Band pay homage to their own history as well as to Mercury's legacy.

Fair enough. Everyone has the right to pledge allegiance to their favorite icons, afterall. It should be noted, however, that Lambert's name was not once mentioned during the show, not even when Queen was introduced for the night's final performance. Lambert made no mention of it prior to the show either, even though his fans and the media were speculating about The Appearance for days. The fact that he was not named has raised questions as to whether this is more than a one-time appearance with Queen, or if he had his name kept silent intentionally in order to honor Mercury's memory.

We're going with the latter.

Though his epic vocal range and captivating theatrical presence has been compared to that of Freddie Mercury, Adam Lambert is far more interested in his own gig at the moment. The singer is now working on the follow up to his hugely successful debut album "For Your Entertainment" which is due out next Spring. His Glam Nation tour was a also world-wide success, solidifying him as one of the most charismatic live performers of 2010. After tonight's performance, Lambert's massive (and ever-growing) fan base ignited the Internet with praise and support for the singer, not once doubting his heart was in the right place.

"What an enormous honor to sing with QUEEN!" he Tweeted shortly after the show. "I could feel the spirit of Mercury alive on stage tonight. Thank u Brian and Roger and crew. LOVE."

So would Freddie have approved?

"The Show Must Go On," he believed. And for tonight, it did indeed.

Adam Lambert Featured In Out Magazine's 2011 Out 100, Reconciles With Editor In Chief Aaron Hicklin

Two years ago if you said Adam Lambert and Out magazine Editor In Chief Aaron Hicklin would sit down to chat -- much less reconcile -- most fans of the "American Idol" singer would laugh you out of the room.

But that's exactly what happened earlier this fall when the Out editor interviewed the pop star for the 2011 Out 100, the magazine's annual tribute to the 100 LGBT people of the year, due out later this month.

When Lambert was featured on the cover of the 2009 Out 100 issue, his appearance was accompanied by a scathing Editor's Letter in which Hicklin lashed out at Lambert's record label and management team for telling writer Shana Naomi Krochmal she shouldn't make the singer come across as "too gay," and suggesting she didn't bring up political topics like the March on Washington, which was taking place the weekend after the interview.

Lambert responded to the controversy by tweeting:

"Dear Aaron, it's def not that deep. Chill! Guess ya gotta get attention for the magazine... U too are at the mercy of the marketing machine. ... Until we have a meaningful conversation, perhaps you should refrain from projecting your publication's agenda onto my career."

In the interview that accompanies the photo, the singer and Hicklin discuss Lambert's passionately defensive fans, his upcoming sophomore album, and his inspirations.

Adam Lambert: No, but all's fair in that game. I think it's been character building, which is great, and it's definitely put me where I'm at now. I think the hardest thing about being a gay celebrity is that we're in the middle of a social rights movement and it's a very hot topic, so we're at a very pivotal time. Coming out was great, but there are certain issues that always surprise me and I think, Why is this an issue? I live and I’ve grown up in a space that is very accepting and open-minded; I surround myself socially with people that are artists and very bohemian and I forget sometimes that, OK, we’re dealing with mainstream culture now, which does not have the same mentality as I do. I think, too, that by nature I’m very contrary. If you tell me I can't do something then I'm gonna push back harder and do it. I'm kind of rebellious, but I try to do it with a smile. I'm not a jerk about it.

Two years ago, in the 2009 Out100, we anointed Adam Lambert “Breakout Star of the Year,” and shot him for the cover, alongside Dan Choi, Wanda Sykes, Cyndi Lauper, and Rob Marshall. In the accompanying editor’s letter I took the entertainment industry to task for the way they control and limit access to the gay press, using our experience with Adam’s publicist at the time as my example. In hindsight, I was mistaken to address the letter directly to Adam: Although the massive response from his loyal fan base started a valuable debate, my letter was received as a personal attack that muddied the message. Lambert rightly sought to defend himself, in part by demonstrating his independence at the American Music Awards, when he simulated oral sex and kissed one of his band members. A lot of time has passed, and we can look back on that firestorm with cooler heads—so cool, in fact, that we were able to chat together, something we should have done first time around. This year we are honoring Adam for the way in which he has held true to his identity as a gay man while managing a successful musical career, a balancing act that is no mean feat. As he told The Advocate recently, “No one teaches you how to be a gay celebrity.” In a very real way he is leading the way.
