In a nutshell, the Script has hired the same lawyer from the Blurred Lines case and claims that they turned down working with James in 2014 only for him to go and copy “the essence” of The Man Who Cannot Be Moved in order to create Say You Won’t Let Go.

There's about a million other songs that came before "Say You Won't Let Go" and "The Man Who Can't Be Moved" that sound exactly like those songs.

Unless the composition is copied note for note or lyrics are copied word for word without giving credit, I don't see much ground to sue. It's no longer about that unfortunately. Jidenna credited Iggy Azalea and her writers/producers from "Fancy" on "Classic Man" to avoid a lawsuit because they had a similar sound. Ed Sheeran is going through it now with the Gaye family over "Thinking Out Loud", which I do believe has lifted elements from "Let's Get It On", but that's a story for another day. This is all stemming from the "Blurred Lines" case where there were no note similarities or even melody lifted but they lost because it contained the "essence" of the song. An unprecedented ruling that opened up pandora's box for so many people. Sam Smith had to credit Tom Petty and others on "Stay With Me" because of the same thing after being sued.

It has basically the same verse, so The Script has the point - the essence is that James Arthur managed to do cheesy song even cheesier - so the essence is the cheese:) Another reason is that The Script is not so hot these days - which means they have to find other sources of income rather than new music - I guess they found it here!
