I'm incredibly surprised to see this going for adds on October 10.
Also, according to AllAccess, this is being released by Victory Records. Is it possible for the label to release songs under the bands' name if the band has already left? If they still have legal ties to the album, I'd imagine Victory can basically do whatever they want with the album, which may include making poor single choices intentionally. In this case, it's pretty much your standard-fare Heights song. Don't see it making top 50, unfortunately.

I'm sooooooooooo confused. I don't even know how they're still headlining the Nintendo Fusion tour without Victory.
I've grown to love this song and I even think its one of Hawthorne Heights best work. It will be a big hit on my personal chart, haha. But an actual single? Big WTF reaction. But its not like some of the catchier songs like "Dead In the Water" and "This Is Who We Are" would've done anything either way. :(

But its not like some of the catchier songs like "Dead In the Water" and "This Is Who We Are" would've done anything either way. :( I'm glad you reminded me, Tortuga, because I completely forgot about their headlining of the Nintendo Tour. 30 Seconds To Mars, The Sleeping, Plain White T's, and possibly my second favorite of the bunch, Emery, are also on the tour. The two songs you mentioned are actually my favorites from the album behind "Saying Sorry". "This Is Who We Are" is a great catchy song, but its repetitiveness doesn't really make it single material, IMO. The loud guitars and screams in the bridge of "Dead In The Water" would have made it a great second single, to follow up a lighter song ("Saying Sorry") by their standards. I was just so disappointed that they released "Pens & Needles", it was just such a standard fare song, and didn't stand out as much as their other works. At least I'm glad there is someone else on this list who appreciates Hawthorne Heights.

I was actually also thinking This is Who We Are would make sense. They'd even already had a video sent out to Fuse for it.

SEEKING COURT VICTORY: Victory Records has filed suit in an Illinois court against Carbon Copy Media, a label started by Hawthorne Heights singer J.T. Woodruff and partner Mark Daily, claming the company breached their distribution agreement with the label, using its assets for personal purposes. Victory originally inked Carbon Copy to a distribution deal for its roster of acts, releasing an album by A Day In The Life, the precursor to Hawthorne Heights, along with discs by Ellison and Signal Home. Victory claims to have lost more than $200,000 in connection with the deal, when Carbon Copy broke off communications, which directly preceded the Hawthorne Heights legal filing to get off Victory. The suit asks for $200k in damages plus interest in addition to court and attorney costs. Victory is also litigating EMI and Hawthorne Heights for Virgin’s signing an agreeement with the band.
